These Terms govern your purchase and use of the SquitterPro software, website, and related services ("the Service") provided by Anthony Rose ("we", "us"). By purchasing, downloading, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Your use of the SquitterPro application is also governed by the End User License Agreement, presented when you first run the app. In case of conflict about the software license specifically, the EULA controls.
You must be able to form a binding contract to purchase. If purchasing for an organization, you represent that you are authorized to bind it.
SquitterPro is offered as a free tier plus optional paid "Pro" features unlocked by a license key. Prices are shown at the point of sale. Payments are processed by Lemon Squeezy as merchant of record; their terms also apply. (Optional tips are handled separately by Ko-fi.) A license key is for your personal use on computers you own or control, is limited to a set number of device activations, and may not be shared, resold, sublicensed, or published.
Because a license key unlocks digital functionality immediately, purchases are generally non-refundable once a key has been issued. If the Software does not work as described and we cannot resolve it, contact us within 14 days at SquitterPro@proton.me and we will consider a refund in good faith. This does not limit any non-waivable statutory rights you may have.
You agree not to reverse engineer, circumvent, or tamper with the licensing; generate, share, or traffic in license keys; resell or redistribute the Software; use the Service to violate any law or third-party right; or overload or abuse the third-party data services the Software uses.
The Service displays data from third parties (map tiles, aircraft photos and registration data, weather, community ADS-B feeds, and ACARS via airframes.io). That data belongs to its providers and is subject to their terms; some features require your own third-party account or API key. We do not guarantee the accuracy, completeness, timeliness, or availability of any third-party data, and a provider may change or discontinue access at any time.
The Service is for informational and hobbyist use only. It is NOT certified for air navigation, air traffic control, flight planning, collision avoidance, or any safety-of-life purpose, and must not be relied upon for any such use.
We retain all rights in the Software, website, and branding. These Terms grant you no rights in our trademarks. Third-party components remain the property of their owners.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
These Terms apply while you use the Service and terminate if you breach them; on termination you must stop using and remove the Software. Sections that by their nature should survive will survive.
We may update these Terms; the "Last updated" date will change and the current version is available in the app (About) and here. Continued use after a change means you accept it.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles, subject to any mandatory consumer-protection rights in your place of residence.
